ShoutWiki reserves the right, at its sole discretion, to modify or replace the Terms of Use at any time. If the alterations constitute a material change to the Terms of Use, ShoutWiki will notify you by posting an announcement on the Site or on the mailing list. What constitutes a "material change" will be determined at ShoutWiki's sole discretion, in good faith and using common sense and reasonable judgment. You shall be responsible for reviewing and becoming familiar with any such modifications. ShoutWiki is a hosting provider, and takes no responsibility for the content uploaded by third parties. ShoutWiki wikis are provided "as is". ShoutWiki has no responsibility for lack of availability of any wiki or of any particular content. You should be aware that the wikis are editable by the public, and, as such, may contain inappropriate content at any time. Any use you make of content hosted by ShoutWiki must be in line with the terms of that wiki's license. Most ShoutWiki sites are available under either a Creative Commons license or some other free content license.

Any content you upload or post to any ShoutWiki wiki must be compatible with the relevant license, not violate another person's intellectual property or infringe on any copyright, patent, trademark, trade secret, or other proprietary rights. No content shall be added which violates any applicable law, including local, state, national, and international laws. Any wiki may host advertisements, promotions, and/or a sponsored search box. Only official ShoutWiki advertisements may be shown. No user shall add advertising that has not been approved by ShoutWiki. No user shall remove the advertising, or sponsored search features from the wiki in a way which means other users can not view the advertisements. ShoutWiki takes no responsibility for the content of externally provided advertising. The content of advertisements may be protected by copyrights, or other proprietary rights and laws, and should not be assumed to be available under the terms of any free content license. ShoutWiki will never host pop-up adverts.

The Services may provide, or third parties may provide, links to other World Wide Web sites or resources. Because ShoutWiki has no control over such sites and resources, you acknowledge and agree that ShoutWiki is not responsible for the availability of such external sites or resources, and does not endorse and is not responsible or liable for any Content, advertising, products or other materials on or available from such sites or resources. You further acknowledge and agree that ShoutWiki shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such Content, goods or services available on or through any such site or resource.

We respect the intellectual property rights of others and we prohibit users from uploading, posting or otherwise transmitting on the ShoutWiki website or service any materials that violate another party's intellectual property rights. When we receive proper Notification of Alleged Copyright Infringement as described in our Copyright Policy, we promptly remove or disable access to the allegedly infringing material and terminate the accounts of repeate infringers as described herein in accordance with the Digital Millenium Copyright Act. If you believe that any material on the Site infringes upon any copyright which you own or control, you may send a written notification of such infringement to our Designated Agent. User information is stored on servers in the United States and other countries. The only information that you need give is a username and password. The username does not need to be your real name. Therefore, any personal information you choose to give is not compulsory. ShoutWiki sites are not intended for, and may not be used by, children under the age of 13 years old. You may change your email in your user preferences. If you choose to enter a real name in your preferences, this will be publicly available. However, this field is optional, and there is no requirement for any user to give a real name.

Information from our server logs may be stored and used to gather aggregate data about users, and used to determine whether the identity of one or more users is the same in cases of abuse. This data includes your IP address, and details about your browser. Your browser must permit cookies to be set (by *.shoutwiki.com) in order for you to log in to ShoutWiki. If you do not make an account on any wiki, you need not accept cookie requests from this site.

Edits by users who are not logged in will show the user's IP address in the page history of the article they edited, and also in other places on the site, including watchlists and recent changes, and in any external feeds made of such pages.

You acknowledge and agree that any questions, comments, suggestions, ideas, feedback or other information about the Site or the Service ("Submissions"), provided by you to ShoutWiki are non-confidential and shall become the sole property of ShoutWiki ShoutWiki shall own exclusive rights, including all intellectual property rights, and shall be entitled to the unrestricted use and dissemination of these Submissions for any purpose, commercial or otherwise, without acknowledgment or compensation to you.

ShoutWiki may terminate or suspend any and all Services and your user account immediately, without prior notice or liability, if you breach any of the terms or conditions of the Terms of Use. Upon termination of your account, your right to use the Services will immediately cease. If you wish to terminate your account, you may simply discontinue using the Services. All provisions of the Terms of Use which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

These Terms of Use constitute the entire agreement between you and ShoutWiki regarding the use of the Site and/or the Service, superseding any prior agreements between you and ShoutWiki relating to your use of the Site or the Service. The failure of ShoutWiki to exercise or enforce any right or provision of these Terms of Use shall not constitute a waiver of such right or provision in that or any other instance.

If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect. If any provision of these Terms of Use shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Terms of Use and shall not affect the validity and enforceability of any remaining provisions.
